The July 1 visit, conducted by Teresa Camara and Elsie Campos, substantiated an allegation that the facility did not display an ombudsman poster in the memory‑care unit where residents could see it. The evaluator noted that the poster was present only in an activity room but not in the unit itself, and cited a deficiency under CCR 87468.2(a)(10). A plan of correction required the posting of a proper ombudsman poster by July 8, 2022.

On October 10, Kelly Dulek and Diego Cortez determined that staff were routinely waking memory‑care residents at 4:00 a.m.—a practice not authorized by any resident’s plan of care. Interviews revealed that residents generally resisted the early wake times, and that the practice was imposed by management after a shift change. The investigators deemed the allegation that staff violated residents’ personal rights to be substantiated and cited a deficiency under CCR 87468.1(a)(3). The executive director agreed to cease early waking unless written permission was provided, and staff training on personal rights was to be completed by October 17, 2022.

A subsequent visit on November 29, again led by Teresa Camara, addressed a complaint that staff failed to treat residents with dignity, stemming from a resident’s fractured wrist after a fall when staff allegedly ignored the resident’s wish to remain in bed. This investigation confirmed the allegation as substantiated, though the report notes that further investigation was still pending at the time of filing. The pattern across all three visits shows repeated non‑compliance with California’s licensing standards for resident rights and safety, including inadequate signage, improper resident wake‑up procedures, and disrespectful care practices. The facility’s administrators—Kim Bergan, Eric Mensah, and executive director Chris Andersen—were involved in each encounter, yet the reports do not indicate whether corrective actions were fully implemented beyond the initial plan‑of‑correction dates. These findings underscore an ongoing risk to resident safety and dignity at OAKMONT OF RIVERPARK.
