Welcome to Assisted Living Magazine. These Terms of Service (the “Terms”) govern your use of assistedlivingmagazine.com and assists.com (the “Sites”) and the senior living search services we provide (together, the “Services”). The Services are operated by NHM Placeholder, LLC, doing business as Assisted Living Magazine and Assists.com (“we,” “us,” or “our”), located at 524 Broadway, 10th Floor, New York, NY 10012.

By using the Sites or Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

Please note: these Terms contain an arbitration agreement and class action waiver in the “Dispute Resolution” section below. It affects how disputes between you and us are resolved, and it includes instructions for opting out.

What We Do

Assisted Living Magazine is a free resource that helps families research and find senior living options, including assisted living, memory care, independent living, and nursing homes. Our directory combines public government data, information from communities, and our own research. Our care advisors can help you compare options, arrange tours, and understand pricing.

Our Services are free to families. We may receive a referral fee from a senior living community if you move in after we connect you. Referral fees do not determine our rankings, which are based on objective data — see How We Make Money and our ranking methodology pages for details.

Not Medical, Legal, or Financial Advice

The Services provide information to help you research senior care. We are not a healthcare provider, and nothing on the Sites — including articles, cost estimates, rankings, and advisor conversations — is medical, legal, or financial advice. Decisions about care should be made with qualified professionals such as physicians, attorneys, and financial advisors. In an emergency, call 911.

Eligibility

You must be at least 18 years old to use the Services.

No Accounts, No Fees

You do not need to create an account, and we will never ask you for payment. We do not collect credit card numbers, bank information, or any other payment details from families using our Services. If anyone claiming to represent Assisted Living Magazine asks you for payment information, do not provide it and report it to us at privacy@assistedlivingmagazine.com.

Communications

When you submit your contact information through the Sites, you are requesting that our care advisors contact you by phone and email about your search. We send text messages only to people who specifically request them after making initial contact with us. Consent to be contacted is not a condition of any purchase, and you can stop communications at any time by replying STOP to a text, unsubscribing from emails, or emailing privacy@assistedlivingmagazine.com.

Information About Communities

Community profiles, pricing estimates, availability, ratings, and rankings are compiled from government datasets, the communities themselves, and our own research. This information changes frequently and may contain errors or be out of date. We work hard to keep it accurate, but we do not guarantee it. Always verify details — including pricing, availability, licensing, and care capabilities — directly with a community before making any decision. Your Relationship With Communities

We are not a senior living provider, and we do not operate, endorse, or guarantee any community listed on the Sites. Any agreement you enter into with a community, including residency agreements, pricing, and care arrangements — is solely between you and that community. We are not a party to those agreements and are not responsible for the care, services, or conduct of any community.

Acceptable Use

You agree to use the Sites only for their intended purpose: researching senior living options for yourself or someone you assist. You may not:

• Scrape, crawl, or extract content or data from the Sites by automated or manual means (see our Data Usage Policy)
• Use the Sites to build or train a competing product, dataset, or AI model
• Submit false or misleading information, or impersonate any person or organization
• Interfere with the operation or security of the Sites
• Use the Sites for any unlawful purpose

Our Content and Intellectual Property

The Sites and their content — including text, design, code, photographs we own, data compilations, rankings, and the Assisted Living Magazine and Assists.com names and logos — are owned by or licensed to us and protected by intellectual property laws. You may view, share links to, and print pages for personal, non-commercial use. All other rights are reserved.

Feedback and Submissions

If you send us feedback, reviews, testimonials, photos, or suggestions, you grant us a non-exclusive, royalty-free, worldwide license to use them in connection with operating and promoting the Services. You are responsible for anything you submit and confirm you have the right to share it. We may edit, decline, or remove submissions at our discretion.

Disclaimer of Warranties

THE SITES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF INFORMATION ABOUT SENIOR LIVING COMMUNITIES.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF YOUR USE OF THE SITES OR SERVICES, OR YOUR DEALINGS WITH ANY SENIOR LIVING COMMUNITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify and hold harmless NHM Placeholder, LLC and its officers, directors, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Sites.

Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Informal resolution first

Most concerns can be resolved quickly. Before starting arbitration, you agree to contact us at privacy@assistedlivingmagazine.com or by mail at 524 Broadway, 10th Floor, New York, NY 10012 with a description of your dispute, and we will both attempt in good faith to resolve it within 60 days.

Binding arbitration and class action waiver

If we cannot resolve a dispute informally, you and we agree that any dispute arising out of these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. The Federal Arbitration Act governs this agreement. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. The arbitrator may award the same individual relief a court could, and any arbitration hearing will take place at a location reasonably convenient to you or by phone or video.

If the value of your claim is $10,000 or less, we will pay all AAA filing, administration, and arbitrator fees at your request.

Your right to opt out

You may opt out of this arbitration agreement by emailing privacy@assistedlivingmagazine.com within 30 days of first using the Services, with your name, contact information, and a statement that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page (or, for material changes, no earlier than 14 days after posting). Your continued use of the Services after changes take effect constitutes acceptance. Material changes to the arbitration section may be rejected by written notice within 30 days, in which case the prior version applies to you.
