The 15 February 2022 visit revealed several compliance gaps at Mariposa at Ellwood Shores. Licensing Program Analyst Toan Luong found that the facility had not completed fit‑testing of N95 respirators for staff, a lapse in the Infection Control Module. More pressing, the review of staff schedules uncovered three employees working without California criminal‑record clearances and four cleared staff absent from the personnel roster. An immediate civil penalty was imposed under Title 22, Division 6 Chapter 8 Article 06, and the administrator was directed to remove the non‑cleared staff, hold an in‑service for directors, and submit a training log by 16 February 2022.

On 30 March 2022, a separate case‑management inspection—linked to complaint #29‑AS‑20210830163115—identified deficiencies in the resident service process. Resident R1’s service plan, last updated 24 July 2021, was not revised after multiple falls requiring hospitalization in August 2021, and no Unusual Incident Reports were received for those incidents. The resident‑services director claimed to have faxed reports, but records showed a substitute nurse was on duty, suggesting miscommunication and potential risk to residents. The licensing evaluator cited violations of the Reappraisals and False Claims statutes, with a plan of correction due 1 April 2022, and noted that failure to comply could trigger further civil penalties.

A follow‑up infection‑control inspection on 4 August 2022, conducted by LPAs Jeannette Olson and Kristin Kontilis, painted a more positive picture of the physical environment. The facility’s assisted‑living and memory‑care units were in good repair, fire and carbon‑monoxide detection systems were adequate, and kitchen and medication storage areas met hygiene standards. A mitigation plan had already been submitted, and the facility was not cited for environmental or fire‑safety deficiencies at that time. Together, these reports illustrate a pattern of administrative and reporting lapses—particularly regarding staff clearances and incident documentation—contrasted with ongoing efforts to maintain safe housing conditions and to rectify identified deficiencies within the required timelines.
