Rialto Assisted Living (Facility No. 361880660) was the subject of four unannounced inspections by the California Department of Social Services Community Care Licensing Division, all conducted by Evaluator Crystal Colvin. The visits addressed four distinct complaints lodged with the agency between February 2020 and July 2021.

Three of the complaints were determined to be unsubstantiated or unfounded. In the pest‑control allegation, the evaluator reviewed records, interviewed staff, and inspected the kitchen; no evidence of pests or recent infestations was found, and the facility’s routine weekly pest‑spraying program was confirmed. The refund‑denial complaint involved a resident who left the facility in May 2020 after a medical emergency. The evaluator examined the resident’s admissions agreement, payment records, and the refund check issued to the resident’s power of attorney, finding that the facility had complied with the contractual terms and had refunded the appropriate amount. The medication‑administration complaint involved a resident who had a documented history of refusing topical treatments. Records and staff notes showed that refusals were recorded in separate notes, and no statutory requirement exists to log refusals on the medication administration report; therefore the allegation could not be substantiated.

The fourth complaint was found substantiated. The agency investigated a failure to seek timely medical attention for resident R1, whose rash was first noted on February 23, 2020. Staff did not report the rash to the resident’s power of attorney or seek medical care until the following day, when a 911 call was made but the resident declined transport. Attempts to contact the power of attorney were unsuccessful. The delay violated the facility’s duty to provide prompt medical care and to involve the resident’s representative.

Overall, the inspections revealed that while most concerns were addressed through proper documentation and standard procedures, the substantiated finding highlights a critical lapse in emergency medical protocols. The facility should review and reinforce its procedures for reporting and responding to resident health emergencies to ensure compliance with California’s safety and care standards.
