Review of the resident’s medical chart, re‑assessment notes, and staff interviews established that the Regional Nurse had determined the resident’s medical condition had escalated to a level of care that the facility could not provide. However, the facility failed to follow the required eviction procedure, including issuing a thirty‑day written notice to the resident’s responsible party and notifying CCLD. The investigation found these procedural omissions, meeting the preponderance of evidence standard, and therefore substantiated the allegation of unlawful eviction.
