January 2023 annual survey cited five deficiencies in staff competency validation, physician notification, missed medications, medication observation, and pharmacist review follow-up. August 2023 construction survey cited five deficiencies in mechanical systems, emergency equipment, fire-rated doors, electrical systems, and exhaust ventilation.

August 2023 complaint investigations substantiated failure to timely report resident abuse to Adult Protective Services and medication error rate of 7.69 percent. January 2024 follow-up survey cited one deficiency in exhaust ventilation. May 2024 follow-up survey found all deficiencies corrected. August 2024 complaint investigation substantiated critical incident: nonverbal severely cognitively impaired resident left unattended in shower resulting in deep partial thickness thermal burns to bilateral thighs and perineum requiring hospitalization; facility failed to notify medical provider timely.

August 2024 annual survey cited five deficiencies in inadequate supervision resulting in six unwitnessed falls with fractured arm and laceration, missing referral and follow-up, missing therapeutic diet menus, medication errors, and failure to observe medication. January 2025 annual survey cited four deficiencies in advance directive documentation, missing oxygen signage, unsecured medications, and inaccurate payroll data. April 2025 complaint investigation substantiated medication error: medication aide administered another resident’s medications to resident; resident hospitalized for precautionary evaluation with no adverse effects. No fines or license suspensions are records.

The facility’s 3-star CMS rating and 79 percent worse-than-average deficiency rate reflect serious operational failures. The August 2024 substantiated thermal burn incident with a nonverbal resident left unattended in shower causing deep partial thickness burns requiring hospitalization represents catastrophic failure.

A substantiated complaint investigation in July 2025 revealed failure to report physical abuse. Staff A slapped Resident #2 after the resident pinched staff. The facility investigated and deemed the incident unsubstantiated but failed to complete required 24-hour initial allegation report and 5-day investigation report to the Health Care Personnel Registry. Medication order clarification also failed for two of five residents involving multivitamin starts, inhaler changes, incomplete insulin orders, and antifungal cream.

Therapeutic diet and medication management failures characterize The Shaire Center’s regulatory record. Over four years, the facility averaged 8.5 deficiencies annually, 63 percent above North Carolina’s 5.2-deficiency baseline. February 2024 annual survey documented failure to provide matching therapeutic diet menus for physician-ordered pureed diets and failure to ensure proper consistency; pureed foods contained small pieces and were not smooth, with staff using mechanical soft menu as guidance. March 2018 documented inaccurate medication administration records for controlled substances (Xanax, Ativan, Oxycodone, Tramadol, Guaifenesin cough syrup with codeine) showing significant discrepancies between controlled drug logs and MAR, and missing physician order for assist bed rails used as restraints for a resident with fall history.

Fire safety infrastructure failures recur across construction surveys. July 2018 construction survey identified 19 deficiencies spanning special magnetic locking exits failing to unlock on emergency release activation, missing bathroom hand grips, corridor obstructions, improperly stored oxygen cylinders, missing fire suppression and extinguisher inspection documentation, non-functional emergency lights and exit signs, compromised fire-rated walls and ceilings, non-latching corridor doors, exposed sharp edges on hold-open devices, and non-functioning exhaust ventilation. August 2016 construction survey documented missing current sanitation and fire safety inspection reports, unsecured oxygen cylinders, algae growth in ice machine drain, missing fire rehearsal records, special locking doors not unlocking on fire alarm, and compromised fire-resistant construction. February 2024 follow-up construction survey confirmed all prior corrections completed with no further action required.

No fines or license suspensions appear in the record.

Families should ask about corrections for the July 2025 failure to report physical abuse, medication order and physician communication protocols, therapeutic diets, and fire safety.

In operation since 1964, the facility offers assisted living, medical care, and nursing and rehabilitative care, accepting both Medicaid and Medicare.

Across nine inspections from December 2014 through June 2025, the facility accumulated 3.4 deficiencies per year, 35 percent better than the North Carolina average of 5.2. That record has improved noticeably in the most recent cycle.

The follow-up construction survey concluded June 16, 2025, found zero deficiencies and confirmed all previously cited issues corrected. Before that, a Construction Section Biennial Survey on April 30, 2025, cited 4 deficiencies: ceiling maintenance failures in the laundry room and exhaust fan grille, improperly stored oxygen bottles, incomplete fire rehearsal logs, and an unsecured light fixture in Room 23. The July 2023 annual inspection, which included a complaint investigation, produced 2 deficiencies, one of them a substantiated complaint in which Resident 4’s television remote was removed from her room, causing distress. The same inspection found failure to notify Resident 3’s family within 48 hours of multiple falls.

The May 2022 annual inspection cited improper medication recording and COVID-19 infection control lapses including absent visitor screening and inconsistent staff mask use. Earlier construction surveys in 2019 and 2017 flagged recurring issues with unsecured oxygen cylinders, fire-wall penetrations, missing grab bars, and odor control; a 2019 annual inspection added a physician-order compliance failure involving a CPAP and oxygen prescription. A 2016 annual inspection cited third-shift staffing insufficiency and failure to maintain administrator presence within regulatory distance. No fines or enforcement actions appear in the available record.

Current occupancy is 23 of 64 beds, or 36 percent, well below the North Carolina average of 76.4 percent. The facility sits in Fairview, an unincorporated community roughly 12 miles southeast of Asheville, with Mission Hospital serving as the primary nearby acute-care resource.

The clean June 2025 follow-up is encouraging; families should still ask about the April 2025 oxygen storage and fire safety corrections and fall notification protocols.
