Within 15 days, two separate Adult Protective Services complaint investigations identified 7 deficiencies spanning resident care, legal documentation, and discharge practices.

July 5, 2023, investigation found a discharge letter that omitted the resident’s right to file a complaint and improperly specified hospital as a discharge location, which is not an approved discharge setting. The investigation cleared allegations about incorrect discharge notice, disrespectful treatment, insufficient staffing, and medication non-administration.

July 20, 2023, investigation documented restraint violations and systemic documentation failures: resident B was restrained in a wheelchair with a seatbelt without a physician order specifying reasoning or timeframe; resident C was restrained with gloves or mitts on hands without physician order; resident B’s admission agreement was invalid because it was signed by a relative without activated durable power of attorney rather than by the resident.

The facility failed to develop an appropriate service plan for Resident B due to the same lack of activated durable power of attorney. No tuberculosis screening was on record for Resident B within 12 months before admission. The facility refused to accept Residents B and C back after hospital discharge, constituting improper discharge practice.

March 2024 renewal found continued problems. Resident A’s tuberculosis screening was completed after admission, not before. Employee A lacked evidence of tuberculosis screening within 10 days of hire.

The July 2023 deficiencies involved use of restraints without clinical authorization, acceptance of legally invalid admission documents, and refusal of appropriate hospital discharge placements. These are structural failures in how the facility manages resident rights and care decisions. The facility corrected neither the restraint practice nor the tuberculosis screening practice by March 2024.
