The California Department of Social Services conducted two separate unannounced investigations at Atria Las Posas, a 140‑bed community care facility. The first visit, on 3 August 2021, followed a 12 May 2019 complaint that a resident had not been receiving a private caregiver, that a special diet was not being followed, and that the resident had been admitted against her will. Evaluator Angel Ascencio interviewed the resident, the administrator, and reviewed the resident’s functional needs assessments and meal‑plan documentation. While the resident reported occasional lapses in menu distribution, the facility’s kitchen had been coordinating weekly modified menus and had staff review these with the resident. Records also showed that the resident’s lease was signed by a family member and that the resident had voluntarily relocated. Consequently, all allegations were deemed unsubstantiated.
The second investigation, on 1 April 2022, addressed complaints received in August 2020 concerning the state of a resident’s room, grooming, laundry services, and billing practices. Evaluator Martha Guzman‑Chavez conducted extensive interviews with the executive director, staff, residents, and family members, and documented photographs of unsanitary conditions—odor of urine and feces, moldy water bottles, soiled clothes left in a bathtub, and improper waste disposal. The facility’s own housekeeping schedule, performed once a week, was cited as insufficient, and staff admitted that extra cleaning was sometimes requested only after residents complained. The resident’s care plan, a Level 4 service, explicitly included weekly linen service, room cleaning, and basic grooming assistance. Despite this, the resident remained unkempt for months, and laundry was often left unwashed in the resident’s room. Billing records revealed that residents were charged for services not outlined in their care plans. All of these allegations were substantiated, indicating significant non‑compliance with both care standards and regulatory expectations.
Across both investigations, a clear pattern emerges: while administrative oversight and record‑keeping appear adequate, the facility consistently falls short in delivering individualized care, maintaining sanitary living conditions, and adhering to contractual service requirements. The first review highlighted gaps in communication and diet management that were not corroborated by evidence, whereas the second uncovered tangible neglect and billing irregularities. These findings underscore the need for targeted corrective actions, enhanced training for housekeeping and caregiving staff, and rigorous monitoring to ensure that the facility meets its mandated care standards and protects resident safety and dignity.
